Terms of Service

1. What YourPond Is

YourPond is a personal contact relationship manager (“the Service”) operated by LilyPadLabs (“we”, “us”, “our”). The Service allows you to store, organize, and visualize information about the people in your life, including their names, locations, jobs, relationships to each other, and other personal details you choose to enter.

2. Eligibility

You must be at least 16 years old to use YourPond. By creating an account, you represent and warrant that you meet this age requirement. If we learn that a user is under 16, we will terminate their account and delete their data.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss arising from unauthorized access to your account.

4. Your Data and Content

Ownership. You retain full ownership of all data and content you enter into YourPond. We do not claim any intellectual property rights over your content.

License to Operate. By using the Service, you grant us a limited, non-exclusive license to store, process, and display your data solely for the purpose of providing the Service to you. We will not use your data for any other purpose, including advertising, analytics, training machine learning models, or sale to third parties.

Data Portability. You may export your data at any time. If we discontinue the Service, we will provide reasonable notice and an opportunity to export your data before deletion.

5. Acceptable Use

You agree to use YourPond only for lawful purposes and in accordance with our Acceptable Use Policy. You may not use the Service to store data about individuals for the purpose of harassment, stalking, surveillance, or any activity that violates applicable law.

6. Browser Compatibility

YourPond is a web-based application designed to work in modern browsers. We do not guarantee compatibility with all browsers or devices. For the best experience, we recommend using the latest version of Chrome, Firefox, Safari, or Edge.

7. Changes to the Service

We may modify, suspend, or discontinue any part of the Service at any time. We will make reasonable efforts to notify you of material changes. Continued use of the Service after changes constitutes acceptance of the updated terms.

8. Intellectual Property

The Service, including its design, code, branding, and documentation, is owned by LilyPadLabs and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our written permission.

9. Availability

We strive to keep YourPond available at all times but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any downtime or data loss resulting from service interruptions.

10. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, secure, or available at any particular time.

11. Limitation of Liability

To the maximum extent permitted by law, LilyPadLabs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of the Service. Our total liability for any claim arising under these terms shall not exceed the amount you paid us in the twelve months preceding the claim, or $50, whichever is greater.

12. Indemnification

You agree to indemnify, defend, and hold harmless LilyPadLabs and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Service, your violation of these terms, or your violation of any rights of a third party.

13. Dispute Resolution

Any disputes arising out of or relating to these terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the United States. You agree to waive any right to a jury trial or to participate in a class action.

14. Termination

We may suspend or terminate your account at any time for any reason, including violation of these terms. Upon termination, your right to use the Service ceases immediately. We will make reasonable efforts to allow you to export your data before deletion, unless termination is due to a violation of our Acceptable Use Policy.

15. Severability

If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms of Service, together with our Privacy Policy, Acceptable Use Policy, and Cookie Policy, constitute the entire agreement between you and LilyPadLabs regarding the use of YourPond and supersede any prior agreements.
